After being called to the Ontario Bar in eighteen eighty-one, Nesbitt established himself as a practicing lawyer. His legal acumen and dedication to the profession led to his appointment as a puisne justice of the Supreme Court of Canada in nineteen hundred and three. However, his tenure on the bench was relatively brief, as he resigned in nineteen hundred and five after two years of service.

He served as the president of the Ontario Bar Association from nineteen twenty-three to nineteen twenty-seven, and later took on the role of national president of the Canadian Bar Association from nineteen twenty-eight to nineteen twenty-nine.
